Kathrine Nichols v. The Order: Where the Case Stands — October 2026

Defendants have moved to dismiss Kathrine Nichols’s federal lawsuit, and she has asked the court for permission to file a second amended complaint.

Kathrine Nichols filed her federal lawsuit against the Kingston Group on January 22, 2025, in the U.S. District Court for the District of Utah (Nichols v. Kingston, No. 2:25-cv-00051). The case is assigned to U.S. District Judge Dale A. Kimball, with pretrial matters referred to U.S. Magistrate Judge Daphne A. Oberg. Here is where it stands, based on the public court docket.

Motions to dismiss and a proposed amended complaint

Defendants have filed motions asking the court to dismiss the case (Dkt. 60, 61, 62). On May 29, 2026, Nichols filed her opposition to those motions (Dkt. 74) and, the same day, asked the court for permission to file a second amended complaint (Dkt. 73).

On June 11, 2026, the court approved the parties’ agreement that, if the request to amend is denied, defendants will have 14 days from that ruling to reply in support of their motions to dismiss (Dkt. 76).

What happens next

The docket shows further entries since August 2026 whose contents are not yet publicly available. We will post an update as soon as they are. No court has decided the allegations, and the defendants have the right to contest every claim.
