The public docket in Kathrine Nichols’s federal lawsuit against the Kingston Group (Nichols v. Kingston, No. 2:25-cv-00051, U.S. District Court for the District of Utah) shows several new filings since our last update. For each of them, only the type of filing and the date are public so far; the documents’ text is not yet publicly available.
Court order on the earlier motions
On August 20, 2026, the court entered an order addressing the motion to amend the complaint and three motions to dismiss (Dkt. 77). The order’s text is not yet publicly available, so we can’t yet report how the court ruled.
Our October 2026 update described the motions to dismiss (Dkt. 60–62) and the request for permission to file a second amended complaint (Dkt. 73) as pending. This August 20 order addresses those motions.
New motions
Since that order, the docket shows these filings:
- September 14, 2026: two motions to dismiss for failure to state a claim (Dkt. 101, 102).
- October 7, 2026: a motion to dismiss for failure to state a claim (Dkt. 123).
- October 13, 2026: a motion to quash (Dkt. 125).
- November 2, 2026: four motions to dismiss for failure to state a claim, one of which also asks the court to strike material (Dkt. 136–139).
The text of these motions is not yet publicly available, so we can’t yet report what they argue. We will post an update when it is. No court has decided the allegations, and the defendants have the right to contest every claim.
